In the first item from O.U.G. no. 104 / 2001 concerning the organization and function of the Romanian Border Police is stipulated both the general prerogatives and the general competence of this institution, so that the Romanian Border Police belongs to the Ministry of Administration and Interior and it is the specialized institution of the state which exercises its own prerogatives concerning the supervision and the control of trespassing the state border, the prevetion and control of the illegal migration and of specific facts of the transborder criminality in the jurisdiction area, the observance of the juridical conditions of the state border, of passports and foreign citizens, the ensuring of the interests of Romanian state interests on the internal Danube and Sulina Channel situated outside of border area, inside the contiguos zone and in the exclusive economic area, the observance of the order and public silence in the jurisdiction area, in the circumstances of the law.
The regulations concerning the activity of Romanian Border Police, stipulated sequential in other laws of organization and function of the institutions of the state, were stipulated in special laws concerning the control of a special type of infringement of the law.
The New Statute of the police officer, adopted by the Law no. 360 / 6th of June 2002, completes and detailes the stipulations concerning the development for this activity in the service of community, in the limits and according to the law.
The legal frame which establishes the organization and the activity of Romanian Border Police is represented by:
o O.U.G. no. 104 / 27th of June 2001 concerning the organization and function of the Romanian Border Police, ratified by the Law no. 81 / 26th of February 2002 and amended by the Law no. 196 / 25th of May 2004; o O.U.G. no. 105 / 27th of June 2001 concerning the Romanian border, ratified by the Law no. 243 / 29th of April 2002 and ratified by the Law no. 39 / 21st of January 2003.
